Anyone can report to CPS

KNOW YOUR RIGHTS

ANYONE can make a CPS Report against YOU to CPS even if it is not true. Moreover, under California law, the person making the report can remain anonymous. (Penal Code section 11167) Therefore, it is common that people make false reports to CPS, especially when there are Divorce or Child Custody proceedings underway. 

An anonymous reporter can be held liable in civil or criminal court if it can be shown that the reporter either knew their allegations were false or made the allegations to CPS with reckless disregard for its veracity or falsity. (Penal Code section 11172)
