New Evidence In Dependency Appeal
Dependency appeals are limited to the existing record, meaning the appellate court reviews only what was presented to the juvenile court. New evidence cannot be added, and the appellate court does not reweigh credibility or make new factual findings. This is why preserving issues and creating a complete record at the trial level is so important. I review your transcripts and documents to determine whether the judge misapplied the law or relied on insufficient evidence. If the court made a legal error, an appeal may correct it even without new evidence.
