Detention Hearing
 
The first hearing in a Juvenile Dependency case is called a “Detention Hearing.” A Detention Hearing is held when a child is removed from the home of one their parents or a guardian. At a Detention Hearing, the Juvenile Judge determines whether the child will be further detained.
 
Timing of Detention Hearing
 
When a child has been removed from their parents and a “Petition” has been filed by CPS, the Detention Hearing must occur in the Juvenile Dependency Court no later than the next judicial day following the filing of the Petition (Welf. & Inst. Code § 315; Cal. Rules of Ct., Rule 5.670(b))
