The CPS social worker has other options rather than removing your children from your home.

First, the CPS social worker can make referrals for services to a family and NOT file a Petition.

Second, the CPS social worker can offer “voluntary” services and NOT file a Petition

Third, the CPS can actually leave your child at home BUT file a Petition.

Another option for a CPS social worker, in lieu, of filing a Petition, can be for a previous non-custodial parent petitioning family court for an emergency placement of the child. This is usually done by an emergency ex parte request in family court.
